Opening Discussion: Technology Leaks and Amendment to the Unfair Competition Prevention Act

As the media continues to report various cases of information and technology leaks, the government is considering amending the provisions of the Unfair Competition Prevention Act that concern protection of trade secrets. The issue has also increasingly attracted the public’s attention. Customer information, operational know-how, and technological secrets are extremely important business resources for firms. At the same time, once such information is leaked from a firm, confidence in the firm can be significantly undermined. Therefore, firms need to properly manage information and put appropriate measures in place. However, with the globalization and greater complexity of corporate activities, it is not easy to reduce the risk of information or technology leaks. In fact, we at Mitsubishi UFJ Research and Consulting have received various inquiries regarding such problems. In light of this situation, we invited Mr. Yokoo, Secretary-General of the Intellectual Property Strategy Headquarters Cabinet Secretariat, and Professor Aizawa of the Hitotsubashi University Graduate School of International Corporate Strategy to have them discuss important points concerning the amendment to the Unfair Competition Prevention Act and the role of firms in this issue.
