Privacy Notice of MU Research and Consulting (Thailand) Co., Ltd.

This Privacy Notice (the “Privacy Notice”) is prepared to inform you (“you” or the “data subject”) of the purposes and details in relation to the collection, use, and disclosure of your Personal Data by MU Research and Consulting (Thailand) Co., Ltd. (the “Company” or “we”) as the Data Controller of your Personal Data, as well as your rights as the data subject according to the Personal Data Protection Act B.E. 2562 (2019) (the “PDPA”) and the subordinate regulations and notifications issued thereunder.

1. Definition

The following terms used in this Privacy Notice shall have the meaning as follows:

“Personal Data” means any information relating to an individual person, which enables the identification of such person, whether directly or indirectly, but not including the information of the deceased persons in particular; and

“Data Controller” means an individual or a juristic person having the power and duties to make decisions regarding the collection, use, or disclosure of the Personal Data.

2. Purposes of the Collection for Use or Disclosure of your Personal Data

We will collect your Personal Data for the use or disclosure to the extent as necessary to accomplish the purposes specified below and in accordance with the lawful basis as provided by the PDPA. In the event of collection of your Personal Data without lawful basis, we will proceed to obtain prior consent from you as required by the PDPA.

(1) Personal Data obtained from members will be used in accordance with membership terms and conditions;
(2) Personal Data obtained from participants in seminars and other events will only be used to provide information about the seminar or event in question or to carry out other required administrative processing. Personal Data obtained from participants in seminars and other events may also be used to contact such participants with information on similar services and other services provided by us;
(3) Personal Data obtained for the purpose of requesting the participation in a survey or questionnaire will be obtained using legal and appropriate methods, and the methods used to obtain the Personal Data will be explained in the message accompanying the survey or questionnaire. This Personal Data will also only be used for the purposes of conducting the survey or questionnaire;
(4) Personal Data obtained from participants in surveys and questionnaires will only be used for the purpose of conducting the survey or questionnaire. Unless permission is explicitly denied, the Personal Data obtained from surveys and questionnaires will also be used for statistical purposes, in such a way that it will not be possible to identify individuals;
(5) Personal Data pertaining to interview surveys will be used for candidate selection, interview requests (including supplementary and additional surveys), preparation of interview records, delivery of rewards and survey results, inquiries regarding the content of responses, and other interview-related tasks;
(6) Personal Data obtained from the employees of our customers and business partners will only be used for purposes such as contacting our customers and business partners on matters of business. Personal Data may also be used to contact such employees with information on other services provided by us;
(7) Records of various inquiries to the Company and Personal Data of visitors will be used for the purpose of responding to inquiries and reception of visitors;
(8) Necessity for the overall business operation of the Company and the Company’s legitimate interests including but not limited to improving our business operation and services, marketing activities, etc.;
(9) Necessity for performance of a contract to which you are a party, or in order to take steps at your request prior to entering into a contract;
(10) Necessity for compliance with the laws which we are required to comply with including but not limited to taxation law, etc.; and
(11) Necessity for establishment, compliance, exercise and defense of the Company’s legal claims.

In case the Personal Data which we will process for the purposes relates to the compliance with the laws or contracts or is necessary for entering into a contract with you, whereby, such Personal Data is necessary for the achievement of such purposes, if you do not provide such Personal Data to us, there may be a legal impact or we may not be able to perform its legal obligations under the contract entered into with you or may not be able to enter into the contract with you.

In the event that we will use the Personal Data obtained for purposes other than those listed above, we will individually notify the data subject of the new purpose of use and will obtain the prior consent from the data subject, if so required by the PDPA.

3. Personal Data to be Collected

We will collect your Personal Data as follows:

(1) your Personal Data such as names, addresses, places of work, and telephone numbers, e-mail addresses, and other contact information; and
(2) any other Personal Data that you have consented to provide to us and that we lawfully received from a third party(ies) according to the PDPA.

We will collect your Personal Data via the following methods:

(1) your Personal Data which you directly provide to us. You may directly provide your Personal Data to us when you contact us, make enquiries, complete forms either by online or by document, request for services or join activities, request for information, receive marketing communications, or provide comments or feedback to us, etc.
(2) your Personal Data which we automatically collect from you. We may automatically collect some technical information, in relation to your devices, activities and visiting patterns and website browsing history, which are your Personal Data, by using cookies and other similar technologies; and
(3) your Personal Data which we received from third parties. We may, from time to time, receive your Personal Data from third parties, such as agents, service providers, government organizations, your personnel and contact person, etc.

4. Retention Period

We will retain your Personal Data for as long as is necessary to fulfill the purposes for which it was collected. We may retain your Personal Data for a longer period if it is permitted or required by the laws, or the Personal Data may be the subject of a legal claim, or may otherwise be relevant for future litigation.

5. Categories of Persons or Entities to whom your Collected Personal Data may be Disclosed

Under certain circumstances, your Personal Data may be provided to our business partners, either in Thailand or in overseas countries, to whom we outsource work or for other business-related purposes. In these cases, we only choose business partners who conform to our internal rules regarding the protection of Personal Data and ensure that they sign a contract agreeing to comply with these rules and handle the Personal Data correctly and appropriately.

Moreover, in order to fulfil the purposes for which the Personal Data is collected, we may disclose or transfer your Personal Data as deemed relevant and necessary to a third party, such as our affiliated and group companies including their personnel, employees, directors, government authorities if we are obliged to do so by the law, banks, legal counsels, consultants, agents, contractors, and other service providers, as well as the persons or entities assigned by us to operate in relation to the collection, use or disclosure of your Personal Data, either in Thailand or in overseas countries.

The disclosure and transfer of your Personal Data to the third parties, either in Thailand or in overseas countries, shall be in accordance with the PDPA.

7. Rights of Data Subjects

Subject to certain exemptions under the PDPA, you have the rights to proceed as follows:

(1) right to withdraw your consent given to us at any time; however, the withdrawal of consent will not affect the collection, use, or disclosure of the Personal Data that you have already given the consent legally;
(2) right to request to access to and obtain copy of the Personal Data related to you, which is under our responsibility, or to request the disclosure of the acquisition of the Personal Data obtained without your consent;
(3) right to receive the Personal Data concerning you in the format which is readable or commonly used by ways of automatic tools or equipment, and can be used or disclosed by automated means. You are also entitled to:
(i) request us to send or transfer the Personal Data to other Data Controllers; and
(ii) request to directly obtain the Personal Data that we have sent or transferred to other Data Controllers;
(4) right to object the collection, use, or disclosure of the Personal Data concerning you, at any time under certain circumstances;
(5) right to request us to erase or destroy the Personal Data, or anonymize the Personal Data to become the anonymous data which cannot identify the data subject under certain circumstances;
(6) right to request us to restrict the use of the Personal Data under certain circumstances;
(7) right to request us to keep the Personal Data relating to you accurate, up-to-date, complete, and not misleading; and
(8) right to file a complaint in the event that we, including our employees or contractors, violate or do not comply with the law on Personal Data protection.

You may contact our responsible person through the channels as stated in item 6 to inquire about your rights and to exercise your rights subject to the PDPA. Upon our receipt of your request to exercise your rights, we will consider your request and inform the result of our consideration without delay but will not exceed the time specified by the PDPA (if any).

8. Changes to this Privacy Notice

We reserve the right to amend the terms of this Privacy Notice at our discretion without informing you in advance to be in accordance with the PDPA and the subordinate regulations and notifications issued thereunder.

Handling of Personal Information

MU Research and Consulting (Thailand) Co., Ltd. (known hereafter as “MURCT”, or “we”) , hereby declare that we will handle our customers’ personal information properly, in accordance with our company’s Personal Information Protection Policy and Handling of personal information below.
The personal information entrusted to us will be used only for the purpose of management of the seminar, notice of the seminar, communication of the results of questionnaires on the seminar, guidance on future seminars, reference to seminar planning, introduction to consulting, information on e-mail magazine reports, and questionnaires and surveys conducted by us, and will be strictly managed.
Even when the prior consent of the individual concerned is obtained, we will only supply or outsource the handling of personal information to third parties who have established sound rules regarding the protection of personal information and who have signed a contract agreeing to comply with these rules and handle personal information correctly and appropriately.
Please be sure to fill in the required items on the registration form. If you do not fill in the required items, we may not be able to accept your registration.
